Buying an apartment from abroad: practical steps

A remote purchase is possible, but legal eligibility, documents, signing and payment should be planned before funds move.

Foreign citizens should not assume identical rules apply to every nationality or property type. First confirm eligibility to acquire title, then select the unit and organise the transaction.

Prepare before reservation

  • passport and tax-residency details;
  • reciprocity review for the buyer's nationality;
  • an independent Serbian lawyer;
  • a personal visit or valid power of attorney;
  • bank evidence for source and transfer of funds;
  • certified translations where required.

Confirm eligibility first

Serbia's Ministry of Justice explains that a foreign individual not conducting business in Serbia may acquire an apartment or residential building subject to reciprocity. The answer depends on nationality and property type.

Review the official Ministry guidance before paying a non-refundable reservation.

Build a local professional team

An independent lawyer can review the developer, registry, CEOP file, contract and release of encumbrances. The notary solemnises the agreement, while your lawyer represents your position in negotiation.

Use a sworn translator and tax adviser where your status requires them.

Make the power of attorney specific

If you cannot attend, the power should clearly cover the contract, annexes, handover and required filings. Confirm form, certification, apostille or legalisation and translation with the Serbian notary before issuing it abroad.

An overly broad power creates risk; a narrow one may stop the process.

Align contract and international payment

Banks may request the contract, recipient details, payment purpose and source-of-funds evidence. Confirm currency, correspondent fees and processing time.

Never send money to an account different from the contract without a formal amendment and professional confirmation.

Organise remote control

Use a video tour together with plans, unit position, view photographs and written specifications. Authorise a competent person to inspect and record defects at handover.

Keep one digital archive for contracts, transfers, translations, reports and final title registration.

Distance must not reduce due diligence

A remote purchase works when reciprocity, representation, translation, payment and handover control are resolved early. The costliest errors come from checking eligibility after reservation.
